There’s nothing in the law that says you shall arrest for DUI. If it was a domestic violence call that law says you shall arrest the primary aggressor. As an officer you can use discretion on lots of things like to cite or arrest or not. Agreeably this probably want to best use of discretion.
What bothers me is that as cop she has to have seen traffic collisions caused by drunk drivers and the carnage they leave behind, yet she thought she was immune? It's not like she was a little tipsy either, she looked incapable to a stunning degree.
