Judges just like cops are willfully malicious with their interpreations.
Yet again illustrating that judges are insulated assholes who have never actually had to deal with the criminal justice system that they preside over.
The problem isn't the education system. It's the police system.
Not that I agree with the idea that you should have to be fully 100% adamant to get an attorney, to get cops to back off, but I want to clarify the courts logic here. Even as much as I don't fully agree with it. It was not the "get me a lawyer, dawg" that got him in trouble, but the statement made before it. "If y’all, this is how I feel, if y’all think I did it, I know that I didn’t do it so why don’t you just give me a lawyer, dawg, cause this is not what’s up. " The logic, and the courts was reaching here, was his request for an attorney was conditioned on if the cops thought he killed a man. And who can tell what the cops are thinking. If the cops at that moment did not think he killed a man, than the request was invalid. Funny that court logic goes, how they will twist it to make it fit whatever outcome they get.
In short do not peak except to say, I want an attorney and I will answer no questions, am I free to leave. No ambiguity, no vacillation, no wavering. Be clear and precise in the speech. And yes SCOTUS cases as well say you must speak as to say I will remain silent, to remain silent in a legal sense in both arrest and pre-arrest environments.
Remember cops lie to convict you.
"I WANT MY LAWYER" and that's it.

It is a crime in itself that we have to say specific, exact words to invoke an amendment during an escelated detainment. I believe all detainments to be escalated and stressful because no free american likes or enjoys being restricted of their FREEDOM.

Well, if I ever find myself in a situation where I am being detained, or handcuffed, the first words out of my mouth are going to be “under my rights of Miranda, I require the lawyer be present from this point forward.“ And that point, the police are not gonna have a choice and they won’t be able to ask me any further questions because I’ve invoked my right. if they don’t like it, well, that’s just tough for them.
