  2. In California, you're not legally required to show the police your identification unless you have been lawfully arrested or if you're the driver at a traffic stop, that been lawfully detained, at which point you must present your ID or driver's license on request.

DUI checkpoints are absolutely unconstitutional, it's simillar to a store stopping everyone exiting the store to make sure you haven't stolen anything, yes people steal, but that doesn't mean they have a right to search everyone who leaves the store just to make sure they haven't stolen anything, so sure people drive and drink, but that isn't ok to stop everyone on the road to ask questions and force people to prove they are sober and insinuates that everyone is drunk till they answer their questions. The Mims law where you have to get out of the car is easy to answer or you can ask the officer if he feels unsafe or feels you are a danger, and if he says no, then he legally can't ask you to get out of the car because that law was menat for officer safety and only allows a cursory search of you, not even a pat down, they are not suppose to even touch you.

    Couldn’t that same rationale apply to cops coming in our homes to check for hostages, stopping random people on the street to check for illegal weapons, or any other invasive detention that has no Reasonable Articulable Suspicion?

    How are these retarded and annoying checkpoints not seen as a direct violation to our Constitutional (or Charter for me) Rights?

    *With the cops loophole being that: Here in Canada it’s deemed that you ‘Consented to Participate’ by enter the checkpoint.
    The provision that the checkpoints are to be posted and we supposedly have the ability to turn to avoid ‘Consenting to Participate’. Except the cops always have ‘chase’ vehicles, where if you turn away, the cops deem that as suspicious and will chase you down and pull you over, even without a traffic infraction.
    *In Winnipeg, our cops have a favourite spot todo DUI checkpoints. It’s at the bottom of a bridge, with the first sign notifying of the checkpoint being as you go onto the bridge. So absolutely no way to turn off (also illegal to perform a U-Turn on the bridge).

    But these checkpoints are still permitted, why? Obviously because they create revenue!
    DUI/unlicensed citations, increase to driver’s license fees, increase to insurance premiums, court fees, attorney fees, and towing fees with impound fees.
    It’s a damn cash cow that never goes dry.

Actually making it more based on traffic-data would arguably make it less consitutional as it will further pre-existing discrimination against any low income group of people, since that is a basic natural law of sociology: poor people are more likely to commit crime or fall into addiction, heavier policing in these areas will lead to more arrest, a higher crimerate, therefor more police-activity and it will spiral from here lowering these people chances even more and pushing them further into the misary that got them into in this case alcoholism in the first place. Only by having them randomly, they are less likely to disproportionally affect poor people to an unreasonable degree.

  7. i remember being a dumb kid, getting out of work and having my mom call me to tell me about DUI checkpoints in the area. Nevertheless I smoked week all the way home, while driving. I drove backroads to avoid any checkpoint. Ironically, the moment I got off the backroads within a 1/3 mile of home I drove right into a DUI checkpoint. Only to be waived on as they had all officers occupied…

  8. Papers please. Any cop who would run one of these checkpoints would be the same type that would load their neighbors into cattle cars. Then claim “ we were just following orders “.

  9. In Finland, these checkpoints have just a guy with a breathalyzer on the side of the road, everyone rolls down their window and blows into it(ofc he changes the mouthpiece for each person). You blow 0, you go on your way never showing them your ID or anything. I'm curious, would a US citizen think that this setup would be an unreasonable invasion of your privacy? I think it's fucking neat. Keeps all the drunk drivers off the road.
