Cops with the Idaho Falls, Idaho Police Department busted in an innocent family’s home, breaking their front door, looking for a third party fugitive. Though the homeowner knew his constitutional rights and demanded a warrant, the cops claimed they didn’t need a warrant because they believe a dangerous fugitive (the girlfriend’s brother) was inside. They did come inside and forced the family outside into the cold for about 30 minutes. During this time period they handcuffed the dad, even though he was suspected of no crime and there was no search warrant for the home. The problem is, according the U.S. Supreme Court in the 1981 opinion in Steagald v. United States (1981), exigent circumstances to enter a home do not exist merely because the police know the location of a fugitive, even if they possess an arrest warrant for that person. They must also have a search warrant for the residence.

  1. Im unsubscribing to this channel. For one reason only. Its a good channel and the content is well made and produced, but it makes me so angry! Genuinely raging at the standard of policing. If our police in the UK all carried guns, im sure we'd be in the same state of the USA

  2. I was asleep on the floor with my 2 year old on my chest, my 5 year old watching a movie in the bed above us, my wife nursing our 1 year old in our bedroom when we were swatted. Scariest moment of my life. Having my kids at gunpoint. I still don't know anything… and not going to find out.

  3. If you cannot depend on law enforcement to go along with statues and laws. Then we're lost in a sea of who is right and who is wrong if law enforcement cannot go by the laws they need to be disbanded and done away with. ATF needs to be disbanded they have grown too long and too much power and their ruling us like we're in a communist country

  4. Even an arrest warrant doesn't give them entry to someone else's house the can sit and wait for them to leave or get search warrant for the house but I'm guessing they have no proof of the person being in there

  5. The officer knew the law that's why he stood outside at first. Then he decided he was above the law and came in to enforce his own version of the law.

    Not saying the homeowners were innocent for harboring a known felon, but that should be handled a different (legal) way.

  6. "come here, you're bothering me- your a safety issue now" self reported, and if he had any right to be in that hosue, you know he wouldnt have stood on the doorstep that long. He knew he was in the wrong and decided to do it anyway.
