Client Educates Cops | They Don’t Listen | He Wins in Court



There’s a dispute between a store and a customer. The store calls the police, reporting something that’s not a crime. The police show up to investigate the said non-crime. They demand ID. Now like many states, West Virginia does not have a “stop and ID” law. However, if they have reasonable suspicion a crime was committed, and that a particular individual committed that crime, they can perform an investigative detention which can involve forcibly obtaining an ID from a suspect. So what is the crime? Can the alleged crime of “trespassing” be used to detain and ID a shopper who has not been asked to leave the store, and who has not been given the opportunity, or even allowed, to leave the store by the responding police officer?

  1. FAR too many people/law enforcement seem to chew & heartily consume the giant Wish Sandwich of shit that originally went by the name of "Right". Just because you "Feel" like it's right doesn't make it 'so'.

  2. So if that is the a win and charges dropis he then able to sue the police department not that it would teach that officer a lesson cause I could see here and the other officer still insist they are right

  5. I'm not an attorney but I've always heard that initially trespassing is a warning and can't become criminal unit said person returns or refuses to leave, if refusal of ID happens they have to go by description?

  8. The female cop is always accusing the victim of 'butting in' when he is standing there silently. Cops should have a better understanding of the state laws before try to enforce a non-existent law. If I were that victim, I would be charging the idiot in Walmart with defamation. He cussed no one, abused no one. He just objected to being singled out for not wearing a mask.
