The “Outlaw Barber” Arrested for Refusing to Close During the Lockdown Files Civil Rights Lawsuit



Today we filed suit in the case of the “Outlaw Barber,” Winerd “Les” Jenkins, a 73 year old combat veteran and former 27-year Deputy U.S. Marshall, who was arrested for refusing to close his barbershop during the Governor’s lockdown in April of 2020. We filed a Section 1983 civil rights lawsuit in federal court, in the Northern District of West Virginia.

He was ultimately arrested by two deputies from the Berkeley County Sheriff’s Office, who transported Mr. Jenkins for incarceration and charged him with “obstructing” an officer. The prosecuting attorney’s office of that county then aggressively prosecuted Mr. Jenkins for the better part of a year, until the judge finally dismissed the charge in January of 2021, finding that it would be a violation of Mr. Jenkins’s constitutional rights to prosecute him for violating the governor’s executive order.

  1. Because of all the circumstances here, this man should NEVER have been arrested. The inspector should have obtained a copy of the order & should’ve signed it. The poor man did everything he could, and the Board should have done at least something to help him.

  2. If he flouted the pandemic orders during the pandemic, fuck him. My asthmatic daughter was 3 and 4, so she couldn't be vaccinated. Anyone who refused to pitch in during the global health crisis can go to hell for putting my kid at risk.

I've seen the body cam video, the Barber was nothing to respectful and the Inspector was the one that escalated thing and convinced the cops to act like her private guard and more or less requested they act like thugs all but saying so, and they seemed to take the hint and proceed as a Thugs with Badges. What a disgrace to their uniform, their badge, and their unit.

  6. 27 years as a u s Marshall, most likely gets a good pension. So not his only source of income. Had a second career as a self employed barber. The state tried to deprive him of his livelihood. This should have been done with more common sense & compassion!

  7. Just like not ALL cops are bad you prove there are some good ethical lawyers out there. Unfortunately 90% of public defenders are corrupt, biased, or simply heartless. I'm glad to see an attorney with conviction.

  9. well is a mandate a law? if a mandate isnt a law can you be arrested and criminally charged? I dont think a mandate is law, therefore no one can be arrested and criminally charged cause a mandate is more like a traffic violation, they are laws but you cant be imprisoned for said violation but you can be fined and if you disagree with it you can fight it out in court. Also seems that if mandates are not laws therefore not criminal but charges always seem to be some law of like you didnt obey a mayors order which seem be Gov overreach in interpreting the laws the govern just how much authority they have when issuing such orders that again are not laws
