#PoliceMisconduct #CaughtOnVideo #CivilRightsLaw Brand-new police body-cam footage shows an outrageous detainment and arrest of an innocent guy shopping in Walmart with his poor toddler. I break it down, explain some of the relevant law, and show what happened. This couldn’t have gone much worse. Multiple Fourth Amendment violations….. and then there’s Walmart.

Reasonable suspicion is required to perform an investigative detention. Probable cause is required to perform a warrantless arrest. The “Graham Factors” are assessed to analyze the legality of the use of force which occurred. I’d guess the police here will fail miserably on all three.

  1. John, threatening to call the sorry contractor Texas calls CPS was pretty low. Texas CPS primarily get's paid for initiating cases and by a formula of continuing activities performed; once CPS gets past your front door they tend to be "in your life " for a while, occasionally to the death.

  2. This is an example of how cops think they assume you are always guilty and then NEED to slam your face into the concrete and because they are good guys we didn’t break your jaw but next time give up your ID we wanna pull the Warrant Slot Machine!

  3. Definitely needs a payout for him and discipline against the scummy police. That kid could have serious emotional issues after seeing his father abused by the police. How the hell can the police not understand something as simple as ID rights.

  4. One of my dreams in life is to drive by every Walmart location, and see nothing but a grassy vacant lot. But unfortunately from my research, they are to be the future sites for FEMA internment camp's processing and compounds for the new federal government. To hell with them all.

  5. The only description is a male with curly hair…I wouldn't call that fella's hair curly. It seems to me they picked him because they thought he would just roll over and do what they say because he had a kid with him and they could say they did their job

  6. I like the fact Mr. Miller tells the officers "You're Dismissed" and yes the SGT did look worried because his boys just screwed up his perfect arrest record over ZERO evidence

  7. Officers should be charged with child endangerment just leaving him there expecting wal Mart to care for him. Imagine if Walmart didn’t touch the kid, they would’ve just left him there. They weren’t even watching him when they were to busy assaulting the dad

  8. In this situation I think I would have surrendered my ID. He was absolutely within his rights not to, but knowing how often police make unlawful arrests for failure to identify, I wouldn't risk it when I was the sole caregiver of a small child. You have to pick your battles.

  9. What is funny here, is that the cop who was talking to the sergeant, was suffering from Blepharospasm. According to the Rare Disease Database, "Blepharospasm is characterized by frequent or forced blinking and eye irritation that often occurs as a result of specific stimuli including bright lights, fatigue, emotional tension, and environmental factors such as wind or air pollution." But, he dosen't suffer from it when talking to the victim. Strange how that happened here.
