  1. There is a real question at stake here, and I don't think it has to do with whether or not he might have been justified in knocking out the EMT, but rather with the possibility that an EMS worker could have very possibly put the life of this individual in jeopardy by spitting on him.

    Spitting on someone is not only an obscene act but also a health hazard. Saliva contains various microorganisms that can cause the spread of infectious diseases. Some common diseases that can be transmitted through spit include:

    1. Tuberculosis (TB): Tuberculosis is a contagious disease caused by the bacteria Mycobacterium tuberculosis. Spitting can spread the bacteria in the air, increasing the risk of transmission to others.

    2. Hepatitis C: Hepatitis C is a viral infection that primarily affects the liver. Spitting can transmit the virus through contaminated saliva, especially if there is a cut or wound in the mouth.

    3. Viral meningitis: Viral meningitis is a viral infection that affects the protective lining of the brain and spinal cord. Saliva can carry the virus, increasing the risk of transmission through direct exposure.

    4. Cytomegalovirus (CMV): CMV is a common virus that primarily causes infections in young children. Spitting can spread CMV through respiratory droplets, leading to infection in susceptible individuals.

    5. Epstein-Barr virus (EBV): EBV is a herpes virus that primarily causes mononucleosis (mono). Spitting can transmit the virus through saliva, increasing the risk of transmission to susceptible individuals.

    6. Human Immunodeficiency Virus (HIV): HIV is a virus that weakens the immune system. Spitting can spread the virus through saliva, particularly if there is no barrier protection, such as a mask.

    7. Covid-19: Spitting can spread the SARS-CoV-2 virus, which causes Covid-19. Saliva droplets can land on surfaces or directly into another person's mouth or nose, increasing the risk of transmission.

    Spitting on someone is a serious offense and is considered assault and battery. Under criminal law, spitting on someone is considered a "willful and unlawful use of force or violence upon another person."

    In the case in which the person transmits a communicable disease which has the potential to lead to life-threatening complications, he or she can be held legally responsible. It is generally assumed that aggravated assault means an assault that results in serious bodily injury to the victim, and is usually classified as a felony offense since it involves serious bodily injury.

    If convicted of felony aggravated assault, the minimum sentence could be several years in a prison.

  2. It absolutely was justified. If somebody assaults you, then you have the right to defend yourself. It doesn't matter if it was a man or a woman. If you don't want to get knocked out, then don't put your hands on someone else. Plain and simple.
