John works for a repo company, and one evening while looking for cars to repossess, the Verizon Fleetmatics tracking software the company uses crashed.

John pulled into the parking lot of a local cleaners to allow the system to reboot and to eat his lunch.

Moments into his meal, and while discussing the issue with dispatch, a deputy of the Hillsborough County Sheriffโ€™s Office pulled in to investigate. Luckily, the vehicle was equipped with front and rear dashcams.

In the current situation, law enforcement certainly has the right to stop and ask questions of John, but at the moment there is no valid reason to legally detain or identify John for simply sitting in his vehicle, even if it is parked on private property, outside of its operating hours.

The officer did not witness a crime or traffic infraction, but does have the authority to ask questions. His authority however, ends at John’s willingness to comply and answer.

With both John and dispatch looking into the validity of the stop, the deputy returns to his vehicle to request a K9 and supervisor.

Upon the arrival of the supervisor and other backup units, John is released, just before the K9 unit arrives.

I imagine that if the k9 unit had arrived earlier, they would have run it on the vehicle and used it to circumvent Johnโ€™s 4rth amendment rights. Recent analyses suggest the dogs are correct around 50 percent of the time. placing their accuracy as about the same as a coin toss. Other studies have suggested that they fail up to 82% of the time.

  1. I'm sick of cops looking for law abiding citizens to harass. They should be looking for real criminals. This is just another blue line predator looking for an easy bust.

How idiotic is it after being harassed and the cop trying to violate your rights you thank him, wish him a good night and tell him to stay safe ๐Ÿ˜‚ how often do people who are harassed wish the person harassing them a good night and to stay safe ? Wow. Why not just let the dumb cop be on his way ?

  3. The cops ability to ask questions stops at "I don't answer questions without a attorney", "I don't consent to any searches or seizures", and "am I free to go . The first question after that gets "STOP INTERIGATING ME WITHOUT A ATTORNEY!" While recording on my cell phone.

  4. The national crisis in policing, of the routine violation of citizens' civil rights, will not end until citizens begin to use lawful self defense to stop the forcible felonies they are being subjected to.

  5. These noobs do the very same thing while on their shift. They'll park up at closed businesses to do paperwork, have a shot of tequila or a quick spliff… give the guy a break you hypocrites!

  6. The k9 couldโ€™ve arrived and been used for a free air search and the driver still does not have to identify himself. There is nothing that they can do LEGALLY to compel his identification and he shouldโ€™ve filed a complaint on all involved for the illegal detention, it may be worth a few dineros.

My cup doesn't know his job at all he's going to call the supervisor and a canine hopefully the supervisor will stop the canine search because it's invalid it's it's an illegal entertainment he does not have to give you his ID you already stated that there is no crime you didn't stop him on the road driving you didn't see him breaking it anything he was sitting there eating his lunch when you walked up to the door he does not have to provide you with anything or answer any questions by law you need to go back to the law library and read up officer you barely been on the job too long for all these new laws that are out and some that are old that you don't remember or you think you remember but you're going to do it your way or or the hard way.

  8. At the end when he asked if you were "GOOD" I would've said "he'll no. You have cost me and this company a lot of time and mental anguish." Just so that would be on record when you took them to court.
