Initially, the incident seems to be going well, with a pleasant wave from the officer.
It seems as though the officer has entered the establishment to solicit a trespass. If you were to ask whether they are allowed to do that, the short answer would be no, however some properties have a No Trespassing Letter on file with the local sheriff’s office which would allow Law enforcement to act as an authorized representative for the property and to trespass whomever they wish.
On July 19, 2019, the Eleventh Circuit Court of Appeals decided Watkins v. Miller, in which the court examined whether, in response to an anonymous 911 call regarding a man in a parking lot, an officer violated the Fourth or Fourteenth Amendment when he stopped Watkins, issued him a trespass warning, and threatened to arrest him if he did not leave the private parking lot.
Watkins argued the officer’s authority and told the officers to check if there was a No trespass letter filed with the sheriff’s office. There wasn’t, nor were there any no trespassing signs.
Eventually Watkins left the property to avoid arrest.
Regarding the claims the court stated:
That a Fourth Amendment seizure occurs when an officer, through physical force or show of authority, terminates or restrains a person’s freedom of movement. However, given that Watkins left of his own free will, he would have believed that he was free to leave, and there was no seizure under the Fourth Amendment.
They also stated that His 14th amendment rights were not violated because Watkins did not allege any specific inadequate process that occurred.
There is a good argument for deprivation of rights under the color of law, but that would have to be argued to the courts.
To date, there is no law, and doubtful are there any department policies that make soliciting a trespass illegal, and we can only argue the ethics.

So while every time I watch a cop act in a disrespectful, disdainful, and extremely rude and overbearing manner it makes me genuinely upset, lately I've been remembering that SOCIETY has given them that cheap air of importance. That they might see an ID refusal as against the rules because NOBODY refuses them. And remembering the letter of the law or anything else can become difficult when people just give in and never challenge you to remember where you can and can't step. There are some disgustingly corrupt cops,a lot of them, but I wonder how much of that mindset is a direct result of the way we treat them. It will never give them the excuse to actually treat any citizen like they're less. Ever. That'll ALWAYS be wrong. But we help plant that seed for sure. So it's gotta be extremely confusing when a person talks back and cops automatically take that shit as malice. They have some disdain for the general public, but I wonder how much of that is a reaction to all of the disdain they pick up from us. Or even wrongly read out of interactions with any one of us. It's like this whole social media comment section thing. People are ridiculously fast at showing contempt toward complete strangers. It's like society is becoming more and more volatile. I just wonder where these major societal emotional shifts will lead us before it's all said and done. Alright Thanks! Have a great life! (But only to those people who take the time to read this AND agree with it. If you don't then obviously I'm smarter and cooler and more put together, so maybe you should 2nd guess your opinion.. because you're obviously an idiot. .. 😊😂)

  2. Obstructing a sidewalk? Many years ago my boyfriend and I were on our way to pick up a bulky item by taxi, when we found a man lying in my apartment building's parking lot. I asked him if I could help and he told me that his daughter had called for an ambulance, and that she would be right back. We stayed with the man, worried that he would be run over, until someone else arrived to keep him safe, and then we got into the taxi. This was on a Saturday. On Monday night I came home from work to find a notice on my door that I had 7 days to move because I had interfered with the welfare of a tenant by obstructing the ambulance attendants from providing medical help to him. On Tuesday morning I was at my building's head office before they even opened, to get further information. I told them what had happened, that I wasn't even there when the ambulance arrived. I was told that the new supers had seen me there and that they had filed the complaint. This couple had been hired about a month earlier, while I had lived in the building for 16 years. It was my word against theirs. Next, I contacted the few ambulance services in the area, until I found the one who had come to pick up the man in the parking lot. They sent me a letter stating that nobody had interfered with their pick-up of this man, I passed that letter on and that put an end to my eviction. When my fridge stopped working a few days later, the new supers had many excuses for not fixing my fridge for two months and were fired not long afterwards. It isn't just police officers who make our lives miserable, it is anyone who thinks they are in charge of us and can do what they like. (By the way, I moved into a house not long after this incident before my year was up. I had to pay rent for three more months even though I was not living in the apartment. I went back to check for mail and found out that my apartment had been rented out while I was still paying for it as well as the new tenants.)

  3. Officer Jolly's name is very misleading and what department allows that much facial hair? But yeah he's in Indiana? Oh yeah extremely corrupt law enforcement, especially Noblesville. Screw Indiana law enforcement, excluding a few individuals.

  4. Another Tyrant piece of crap earning the hate for the cops. Some cops are just plain stupid, walk up to someone with a camera and act like that. That is very stupid. Might better just have a sign on his back. "I'm a stupid bad cop"

  5. An officer using personal insults absorber a citizen on duty should cost the officer $25,000 plus a civil suit settlement of all officer assets including pension plus $50 million.
