That is theft. Not to mention a number of rights violations under color of law, including 2A, & 4A if the cop had no warrant.
It doesn't matter what absolutely obviously unconstitutional nonsense SCOTUS says. It doesn't matter, the courts are NOT allowed to alter or create laws. Period. Under Article VI, judges & public servants at all levels are sworn to uphold the clear language of the constitution. They are NOT sworn to uphold the inarguably unconstitutional ideas of SCOTUS, or juris prudence!
And, in fact, SCOTUS claiming such power was the majority of the Founders #1 concern, & Jefferson & Madison, for example, said it was every sworn servant & the Peoples primary patriotic duty to oppose & put an end to even the smallest attempt by SCOTUS to claim such monarch-like power.
And, of friggin COURSE the Founders never intended SCOTUS, nor ANY other man or government entity to be able to undermine & change our inherent, inalienable, God-given rights! No! The very idea is patently absurd, & it's simply incorrect, & that isn't difficult to prove either. After 2 years of me out here screaming this by myself, the 10A Center has now come out with multiple videos confirming everything I've been saying about case law, including providing a great number of the types of quotes i mentioned above.
This is not a truth that can be escaped, & acknowledging it IS the way, bcuz it is the 100% truth. Case law never existed in the country until after the Civil War, when the Founders were mostly all gone & half of the American people were frightened of freed slaves & vulnerable to allowing that which should never, ever have been allowed. Case law/common law. In Britain they have common law bcuz the judges are authorized to speak for & represent the King in crafting law. The King. We were never intended to have such a system bcuz we dont need it, we have something Brits dont, enumerated rights, & allowing judges to alter those can only lead to the inevitable degredation of those rights, exactly as the Founders prophetically predicted, & we've now seen. Case law nonsense is the root of & justification for ALL the clearly unconstitutional courtroom injustice & police ty##@$y in this country today, from RAS, occifer safety, P v Mimms, detainment, immunity, Atwater v Lago Vista, & so, so much more, including the absolute, most human rights damaging, insane, obviously unconstitutional of all that essentially destroys the 4A, plain view doctrine. And worse, it creates this system in which the wealthy purchase their way out of facing justice & the poor face unclear laws, & a total scam system that they understandably feel it necessary to take pleas even when innocent. The Founders wahted the law to be as simple as possible. So simple that "the common man" could read & understand it, & even represent themselves successfully in court against false charges. These are facts. Case law has ruined all of that, & made an impossibly complicated, murky morass of the law so incomprehensible that no one can honestly claim to confidently know how a court will hold/rule in almost any case. Other than confidence in those who can afford expensive, connected lawyers who can use case law to obscure common sense & beat cases with obviously guilty clients.
The truth is the truth, & the truth will set us free. In the end, the only option is to accept, brother, regardless of perceived cost to lawyers, or anyone else. Nothing else will substitute for the truth in the end. And it's essential that we not only educate folks, but also that we do not add to the great harm by EVER speaking about case law in a way that makes it sound legitimate. It's just not legitimate. It's not. It is currently a reality we must deal with, & so your biz model does not need be destroyed. But all biz models must evolve eventually, & unfortunately in this case u made an understandable error & got something majorly incorrect, & that's a biz reality that must be dealt with by virtually every entrepreneur as well. U are smart, u can evolve & accept the truth in a way that does not ruin u. U can.
