The sergeant’s tone, mood, and attitude change unexpectedly and suddenly when the journalist asks him for his name and badge number. He becomes surly and aggressive, and begins to order the journalist “off of my scene,” stating that because he’s not related to either of the parties, he has no business being there.

It is a matter of settled law that anyone may film police in public while performing their duties. The police may direct journalists to move when lawfully present on public property only if there is a legitimate governmental interest that cannot be accomplished through less intrusive means. Therefore, concerns regarding public safety, officer safety, or preserving a crime scene are legitimate reasons to direct someone to move. But Sgt. Harris appeared to use his power and authority in a reactionary manner to exert control over the journalist by demanding he move.

A sergeant who allows his judgment and decision making to be affected because of perceived disrespect of his authority, because he was asked to provide his name and badge number, or because someone declines to provide their name when they are under no obligation to do so lacks the temperament to hold a position of power. His reactionary and patronizing demeanor indicates a retaliatory motive that influenced the manner in which he conducted himself, which demonstrates an abuse of his authority and discretion. This misconduct indicates he may pose a liability risk to the city due to his immaturity and poor judgment.

The chief of police responded with the following.

    Now that's my definition of an ignorant prick who thinks be is our master not our civil servant!
    MLK fought for equality would question how a black officer does not understand freedom & denies another his civil rights!

  2. The cop took his being asked for his name as a threat to his authority and felt the need to establish his dominance over the lowly citizen. What an insecure tyrant. Sergeants should not be acting like that.

  3. It’s refreshing to see someone who is willing to go to jail for their cause. Complying with unlawful demands “under duress or threat of arrest” is weak and unfruitful. Respect to the journalist.

  4. The second cop trying to spin it for jays safety is a joke. It was clearly because he didnt give his name him being ordered to leave had bothing to-do with the cable. It was pure ego an being triggered thats caused this. Then to try an say no free speech is wow.

  5. Stuff like this which some might argue is a slam dunk is only morally reprehensible this officer who might seem awful in this one video doesn’t reach the lawsuit level, a supreme douchebag definitely!

  6. To be fair, the auditor was in the wrong, and provocked the police officer. In this kind of incident, police tape or not, there is a safe distance to observe, and the police officer had to ask the auditor repeatedly to back up before he complied. The auditor has an aggressive tone from the start, and imho, acted like a jerk.

  7. I don't know why he kept saying he understands when the cop told him it's for his safety, it clearly wasn't, that srgt wasn't concerned for his safety in the least bit. He didn't even try to use it as an excuse, the other cop did to cover for him.

  9. Approaches in an aggressive manner and raises his voice while saying "I'm asking you nicely". This is why officers die. rightfully so. Dead officers do not violate rights. Citizen safety is not an officer's job and officer safety is not a 'concern.

Well Sgt Dikwad, you say you're too busy to be answering questions from him, but you sure seen to have plenty of time to get in his face and yell at him and try to intimidate him and tell him he's going to get arrested if he steps off the sidewalk and he doesn't need to be there and on and on… He's quite the wizard of time management. It's quite impressive that he was able to rearrange his obligations to make so much time in his schedule to dedicate that much of it to this citizen in whom he's taken so much interest in interacting with.

  11. You should comply because he axed you several times. If he axed you that should be taken as a threat. If one of us axed someone that's assault with a deadly weapon.
    How can they axe people and get away with it?
