Corners was driving in Laredo Texas, and noticed a BP helicopter scanning the area. He decided to stop and record. He then noticed a BP ATV and began filming it, when Officer Lugo arrives on scene.

Office Lugo is immediately aggressive. Shining a high powered flashlight into the eyes of Corners. It is important to note that corners is open carrying a pistol on his right hip, and it would be wise for anyone to illuminate a scene like this.

There are recent arguments that because some of the newer high power led lights can cause permanent eye damage, officers should refrain from shining them directly in someone’s eye.
Flashlights are often used as a way to determine whether or not the subject is under the influence. It is also used tactically, to Conceal your body and temporarily impair the vision of your opponent. Lately weโ€™ve seen it done as a retaliatory move to block a camera or cause discomfort to an auditor.
The argument for whether this is a legal detention can be argued. The officer did not observe anything illegal happening. At this point all he knows is that an armed man is filming a government vehicle in the dark.

Reasonable suspicion relies on specific, reasonable inferences, as was described in Terry v Ohio. It is not inchoate and unparticularized suspicion or a mere hunch. A mere hunch is subjective, i.e. the officer imagining that Corners could be stealing from or damaging the ATV. Reasonable suspicion would be an objective fact requiring verifiable and quantifiable evidence, such as observing Corners holding items that should be on the ATV.

Without reasonable articulable suspicion, Corners wouldnโ€™t be lawfully detained, and producing a license to carry wouldnโ€™t be required. Texas is also one of the few states that only requires the production of identification if youโ€™ve been arrested.

  1. I heard the perfect answer to stupid questions a cop will routinely ask. The cop asks what he is doing to the bike. In the movie "Lawrence of Arabia" Major Lawrence is frolicking around in the desert playing with his new cape when the Bedouin leader sees him and asks what he is doing. Lawrence replies, "As you see".

  2. This is ridiculous. The TYRANT AGENT kept saying that the citizen WAS ON THE ATV. He was not on the ATV. The TYRANT should be worried about protection of the border, not accosting the citizen. There are plenty of illegal aliens crossing, that should be the focus!
