  1. This is the definition of excessive force, the whole "exact case" scenario for qualified immunity is BS. There's an unlimited amount of differences that could be made up between two similar scenarios, time of day, whether or not the ground surface they were thrown on was concrete, wood or dirt. The number of people around, the number of police at the scene. Whether the wind was blowing from the north or south that day. Anyone can look at this video and the facts and see that it was excessive. This isn't a case of drawing a line in the sand and saying "Do not cross" like with every other law for every other citizen instead the police are digging a tunnel under it specifically for them to use and claiming there was no line. They didn't see the line so how could they know to stay behind the line?

  2. There needs to be a law stating “For every year a case is open, the Victim should receive 100,000 dollars until the case is closed”

    This would make courts step up there time and stop wasting and delaying the victims time. This is a common tactic of law enforcement and the court system. They will constantly reschedule and delay the trial causing you to travel or spend a lot of money in gas going to and from court dates.

  5. There are so many issues there, not only the first jury, but then the 10th circuit taking its time to arrive to a non-ruling.

    1 incident like that has more impact on the public's consciousness than 100 good gestures from cops. And this qualified immunity doctrine is really a rule from a banana republic.

  7. Fort Collins is notorious for use of excessive force and claiming Qualified Immunity, and this is one of many settlements for use of excessive force. So far in the last 5 years the city has paid out at least 2 million bucks.

Whoa wait a minute the police officer violated the ladies civil rights before the arrest ……the officer put his hands on the lady and at that point escalated the inter action between them which then lead to the arrest . officers can not provoke , incise, or entrap you so they can arrest you where if he would have employed other de escalating techniques she would ave not have been arrested . The officers civil rights violation triggered the lady lady.

  10. Insurance companies like to drag these things out because they can put an amount in an interest bearing account and after 7 years, the interest will pay the judgement or award and the principle is still clear.
    "I don't want to throw you on the ground…" translation – "I can't wait to try my throw you to the ground technique, just give me a reason."

  11. I saw the original video of this when it was first shown and virtually all the comments were saying she deserved it. Not only was I disgusted by what had happened to her, I was equally disgusted by the nasty, sick people and what they were saying.

  13. If you haven't heard, some Australians won a court case vs police for punching them and not getting in trouble for it. The police violently took down a covid protestor during the lockdowns, and his friends fought the police off with fighting, punches/kicking etc. The judge said, people are able to use reasonable force for unlawful assault and arrest by police. Good news for once!

  14. A google search of "Sergeant Randy Klamser who oversees the Fort Collins Police Crimes Against Persons Unit" gives a result that is a sick joke…

    I'm guessing the title is supposed to mean police investigating third party crimes against persons…. but it would more accurately describe Police committing crimes against persons! In this case, it very aptly describes Klamser's crime against a civilian.

    That Fort Collins PD employs this psycopath with such terrible judgement overseeing investigation of crimes against persons is staggering.

    This is why more and more people are seeing police as the enemy, and shed no tears when police meet a violent end. Instead of being part of the remedy to society's problems, police are more and more commonly the cause of problems.

  15. A test before your presentation? Okay. A: Constitutional violation? Yes. 4th Amendment, Graham Factors, the severity of the crime. B: Does the LEO get qualified immunity? Hopefully not (up to the court). The understanding of excessive force is well established and LEOs are expected to know it. C: Does this woman deserve to be paid? Yes. Her civil rights were violated, and she received some injury. D: If so, how much? My opinion? If no permanent injury, call it $150k. If permanent injury? Break out the calculator.

  18. If the officer gets qualified immunity because he couldn't have known it was wrong, doesn't that directly imply there is a training issue in the police department and/or city he is in? Shouldn't it be easier to prove Monel(sp?) when the officers get qualified immunity?
