    I swear to protect and defend a document I will never read or attempt to understand.

  2. They claim that she is violating HIPAA, but cuff and stuff her for "interference." How is it that they can claim a violation of one law, and use that as grounds to arrest under a very different criminal code? The answer would be extra interesting since it'd have to answer how a supposed violation of a Federal civil law could be used as grounds to arrest someone under a state criminal law.

    I was an EMT well before cell phones with great cameras were "a thing." We were trained way back then that the public has the right to film us and our patients as we performed our duties, and we just had to accept that. In order to protect the privacy of our patients, we were to use blankets and gurneys to create a makeshift wall and get the patient into the transport vehicle as soon as medically appropriate. HIPAA was law back then, and we were all trained that no matter how much we wanted to protect "the privacy" of our patient, the fact that they were out in public meant they had no actual privacy and there was no lawful authority to force someone to stop filming as we did our job in public. The only way someone could be considered to be interfering with our treatment is if they were standing in between us and our patient or in between us and any item we needed to get to assist in treating the patient.

  3. $50,000 to the maybe it came out of their insurance policy but the taxpayers pay that as well don't fool yourself. It would be nice if you would give the police department email or phone number of these situations so we can call them and make our own complaints not only what I like them to be inundated with these videos making them obey the law but I would also like them to be inundated with phone calls when they do break the law.

  4. The cop said HIPAA was the health information privacy act. What the actual fuck is that. I learned in nursing school HIPAA was Health Insurance Portability and Accountability Act. These fucktards don't even know what HIPAA stands for. My guess is if they don't know what the law is called then they don't know what is in the law.

  5. Brave with a badge and a gun. Telling her to act like a lady? And pulling her arms up while walking telling her not to resist? These cops have shown there true character. Fire them.

  6. These cops that said the first amendment doesn't suprecede hippa should never be allowed a badge ever ever ever !!!! . How does qualified immunity cover this ?? , its not a mistake , its a blatant lack of IQ , and if you don't know for a fact , you shouldn't enforce !! . The fact that they stated that the constitution doesn't supercede hippa tells you everything you need to know . Disgraceful!

  7. In 1983 in Front Royal, Va. there was a cop that repeated abused his power. Broke arms and legs of those he encountered during arrests. A majority were thrown out. Multiple complaints were filed but since he was the Sargent and the chief was weak none were looked into. Like I said he was a cop. Now he is dead. In 1983 he was shot 5 times, and they never caught the shooter. It’s my understanding that there are those that knew the shooter but no one ever came forward. Not because they were in fear for themselves, but because they felt justice was finally served.
    People will only put up with being bullied for so long.

  8. The day after the settlement, I would have gone to their precinct and recorded inside and out while carrying a sign that said "Please arrest me again for recording. I could use another $50,000.

  9. No, common people can violate HIPPA. If you record a doctor call in an assumed privacy setting (doctors office, your home) and the info is released, third party can get in trouble. Those classes were long and thorough.

  10. The same HIPPAA that is so dated and pre/early internet it still expects Medical to continue to use antiquated faxes. Due to 'security' when faxes are beyond easy to intercept but can't send same by encrypted emails. Deal with this with job a least 2-3 times a year.
