    • police called because a neighbor said Hoover assaulted her
    • as he approached Hoover, Due drew his service weapon and pointed it in Hoover's direction
    • pushes Hoover into his house
    • shoves Hoover into the wall
    • Hoover's hands are down by his side and the officer punches him
    • slams his head into the wall again breaking a hole in the drywall
    • officers leave
    • return the next morning telling him he is being arrested
    • arrested for
    – assault on a first responder
    – resisting arrest
    – assault with respect to the original 911 call
    • stating under oath that Hoover had assaulted" him
    • March 2022 Due given remedial training on
    – de-escalation
    – force on force training

    Lawsuit claims Hoover suffered "multiple sinus fractures" and still experiences "double vision."

    Lawsuit has 4 counts:
    • excessive force by Due
    • malicious prosecution, false arrest & false imprisonment by Due
    • unlawful search & seizure by Due
    • municipal liability by Putnam County

    Because of the incident Hoover & his company were basically 'blackballed' resulting in a decrease in officers and local governments willing to work with him. Resulting in decreased revenues of about $100,000.

    Hoover had actually worked at the Putnam County Sheriff's Department.

    And he recently started a traffic control company that employed off-duty deputies including Deputy Due.

    "The officer had worked for Hoover's company, and Mr. Hoover had actually stopped hiring the officer for jobs due to his work performance," Raybin said.

    The lawsuit claims the deputy received remedial training after the incident but was not disciplined.
