Here is an update: the man won 400,000 in his lawsuit.
The City of Loveland has reached a settlement with a man who was arrested on a DUI charge in 2020 even after he blew zeros during a breathalyzer test and after a blood test came back negative for any drugs.
The City of Loveland, which is insured through the Colorado Intergovernmental Risk Sharing Agency, has agreed to settle for $400,000.
Loveland Police Chief ran when it got a little hot for him. It would be hilarious if the actions of his department did not ruin lives.
It is a fact that alcohol has no odor so how can it be smelled?
What is smelled is additives like flavors. Ask the cop what it smells like.

My father was in a similar situation where he was accused of driving under the influence of alcohol. He blew zeros, and they then insisted he was under the influence of drugs. He was then taken to the hospital and forced to give a sample via catheter and blood was taken. His license was suspended indefinitely, truck impounded, and all cash removed from his person. It took almost 16 months before the courts ever had a record of this arrest. Upon going to court, they had no record of the tests as they were negative and discarded. They then re scheduled another court date and said they found the test results. We showed up and the judge asked the prosecutor why he is being charged with DUI while the tests were all negative? The prosecutor stated that the officer then stated that he knew he was coming off drugs. They then dropped his DUI charge and asked him to plead guilty to to an impeding traffic charge as a means to justify the arrest. The prosecutor demanded the judge find my father guilty of impeding traffic. The judge stood up for what was right and actually tore in to the prosecutor and stated that it was malicious prosecution and that it was the kind of wrongful arrest that costs the government money. All charges were dropped and a lawsuit was filed on my father’s behalf. Unfortunately my father passed before his case was heard.
This is just another example plainly showing that the so called "police" are nothing but a bunch of badge carrying criminals. No really. They are really just criminals who happen to carry badges and nothing else.
The policing and justice system in this country is beyond ridiculous and completely criminal. With all the information out there, why has nothing changed? Oh yea MONEY!

Happen to me and my brother while we were going home in Montgomery county Texas 20-30 miles north of Houston they pulled us over I'm in the passenger seat and he said right as he came up to the car get out or I'm going to get u out so I got out and as soon as my foot hit the ground I was arrested for public intoxication (PI) and they gave my brother a DWI and we begged for a breathalyzer and they ignored us they eventually drew my brothers blood and 0.0 showed up . I never got anything done just guilty on the spot. After we got out jail all our charges were dropped I live in a county were you just can't win against the cops on the streets or in court . 9/10 it's their game and not the laws game

Last update on the lawsuit that I could find was that in November 2023 it was still pending in federal court.
Remain silent, dont consent to any tests, dont sign anything stupid… Cops are violating rights, let them take your licence for blowing 0.00 and go to court.
The arrestee made a good arguing debate with this officer and it REALLY pissed him off……. enough to turn off the body camera…… as I'm sure this is when the officer was itching and challenged him to debate with the arrestee. The officer HAD TO DEBATE w/him as this is how he could sleep better at night (or whatever he's sleeping schedule is) so he can pat his own back, brag to his buddies……..
