  1. Officer: I don't know what you have done YET, BUT I perceive criminal activity AND I need U 2 answer some questions for me & IF U refuse, then I will arrest U for obstructing/interfering with, & hindering OFFICIAL POLICE BUSINESS!!

  2. Hey, Genius Cop.. the Supreme Court has defined it as 'articularable crime. Not some lame brained 'Perceived criminal activity' ,,, You must articulate the crime,,, specifics. Genius Cup,, dumb as a brick.

  3. It does make sense to ask. Even if the officer doesn't have to tell you, he has no reason to withhold this information because divulging it would help somebody establish that the detainment is lawful and therefore earn their compliance. So it makes sense for him to tell you if he wants you to cooperate and it makes sense for you to ask, because if it is an unlawful detainment and if there is no reasonable suspicion, it forces the cop to admit this, in so many words, as was the case here. The "reasonable suspicion" has to be "articulable," so ask the cop to articulate it. If he can't articulate it to you, then there's no reason to think he could articulate it in court, and if he couldn't do it there, anything he found during a warrantless search could be suppressed. I'm not a lawyer, but this is my understanding of the law, having watched a ton of these bodycam videos at this point.

  4. OK so in the second video, Mr. officer got mad because apparently the man pulled up to fast. So cop said sit here and think about it. When it was clear for traffic to go that way he had him sit there. My question is does the cop have the right to hold up all the traffic behind this person because the ass cop got a bur up his but from the guy in front?

  5. “Articulable,” is the pertinent word. “Perceiving,” some undefined criminal activity is not RAS. It could be that the cop ate jalapeños last night and has heart burn which he perceives as criminal activity.

  6. Whenever a cop knowingly violates your rights victims need to start placing said cops under citizens arrest for violating usc title 18 section 242 then file a civil suit or tort during the settlement discussion tell opposing counsel in the interest of the public good you will be willing to take less monetary pay for the cancellation of his academy credentials so he can no longer be able to be law enforcement officer

  7. when you are talking about what is legal and what isn't, it is clear that cops enjoy throwing their weight around bc of being butthurt. has nothing to do with the law except showing who's boss.

  8. one time, in Platte County, MO, i was parked, with my car off, next to the air pump at a gas station while talking on my cell phone. during my conversation, the convenience store closed. shortly after this occured, a police officer suddenly appeared outside my car. he had parked on the opposite side of the building. he then snuck up to my car. when he got to the c-pillar of the driver's side of my car, he shined his flashlight on me, and asked me for my ID. i told him that he just scared the sh!t out of me, and i also said to give me one second to get my ID out of my front pocket. he took my ID, and then told me that i needed to end my call, and to get out of my car. i asked him why. he said to do what he asked. i again asked him why. he said that i looked suspicious, hiding from plain view from the road at a business that was closed. he said something along the lines of being concerned that i might've been casing the place in order to commit a robbery. i replied that i had got a TPS warning which led me to exit the highway, and then proceed to this location to check & put air in my tires. while i was doing that, a friend of mine, who had recently moved to NC, called me. the convenience store closed while i was having a conversation. i then asked him if it was illegal to use the functional air pump at a gas station located next to the exit of a highway, just because the convenience store of the gas station had closed for business for the day. i also said that the air pump, that was just being him, appears to function 24 hours a day, as well as pay at the gas pump services which were still lit up, and i was willing to wager that the lit up pay before you enter automatic car wash works 24 hours a day. he told me that i needed to end my call, and to exit my vehicle. i proposed that maybe after he runs my ID for any warrants, and then finding none, he return my license to me, and i would then leave. he angrily told me that i needed to hang up my phone, and get out of my car. he added that my failure to obey his commands was making things worse for me, and he said that i didn't want to make him force me to get out of my vehicle. i asked him if he was arresting me, and if so, then what was i being charged with as i was pretty sure that suspicion of casing a closed for the day convenience store, at an otherwise functioning gas station, was not a crime anywhere in the country. he said that my hand was shaking when i handed him my ID which meant that i was nervous because he caught me doing something. he then told me that it was the last time for him to tell me to end my call, and exit my vehicle, or he would be forced to break my window, reach in to unlock my door, and then drag me out. at this point, a separate police car had arrived and parked a short distance behind my car with its lights on. so, i finally obeyed his commands. he put me in hand cuffs, and had me sit on the curb next to the air pump. he had the officer who had recently arrived and exited his car stand witness. he asked if i had any drugs or weapons on my person. i said no. he then began to pat me down. before he got to my waist he asked if i was sure, and that if he reached in my pockets he wouldn't get stabbed by a needle or anything. i said that i had no weapons or needles on me. after sesrching me, he proceeded to search my car. he found, what later was determined to be, less than half a gram of marijuana. he said to me that he thought i didn't have any drugs on me. i said that it wasn't. it was in my car. he then asked me how to open the trunk of my car, after he tried to unlock it with my car key. i told him that the lock quit working via using the key which i hadn't gotten repaired yet. i told him that he already had all of the drugs or weapons that was in the car. i then pleaded for him to not break my trunk as there were no drugs or weapons in it. he told me that i was under arrest for the pot. he was going to park my car in a more prominent from the road location, lock it up for me, and then take me to the police station for booking. during the court proceedings, my lawyer had given the judge documentation of a dozen cases similar to mine that had been thrown out due to illegal search and seizure in an effort to suppress the evidence against me. my lawyer had to leave the documentation, and we had to schedule another date to appear for the judge to let us know what he determines about the motion to suppress the evidence, and was the search and seizure illegally performed or not. the motion was denied. i received one year probation for a misdemeanor possession. my lawyer told me that when he went to the judge's chambers to retrieve the documentation that he had left, before court started that day, he walked in on the judge and prosecutor discussing how they were going to handle my case. my lawyer figured that was why i wasn't given the standard two years of probation.

i had another experience a few years later in KS in which i had been literally pulled out of my car and tackled to the ground of a parking lot, put in a choke hold, and then cuffed and arrested. the arresting officer claimed that he smelled marijuana. i had told him to call in a K9 unit, and that i had the right to otherwise not exit my car. the result of that ordeal for me ended with a year probation for resisting arrest. i was not charged with marijuana possession, nor possession of paraphernalia for that matter. even more fun for me was being given "shock time" by the judge. it was explained to me that it was time for me to think about things, meet with a public defender, and also for the judge to be sure that i wouldn't have anything drugs or alcohol in my system. this was in Johnson County, KS. i found out that the judge i had was one of three who owned the New Century Detention Center, the first max security jail in the country. imo shock time was something they made up to ensure the highest head count they could maintain in their facility. i have two other encounters i've had with KS law enforcement that i'll refrain from sharing.

  9. PO-DUNK cop in a PO-DUNK town with little or no training or oversight. The chief probably saved this situaion from getting much worse. My best guess is this department has trouble attracting and retaiing good people (probably due to low pay).

  10. Here is another thing that makes me sick, when your belly hangs out from your body armor and your so out of shape that you could not chase a suspicious person or run to save a person.
Never mind the this horse shit policing. I was a police officer for 5 years in a good size city in Massachusetts. We had some strict physical fitness regulations and they would give those officers time to get back into shape or they could lose their jobs. Unfortunately they changed the policy at some point but I was long gone. They need classes on the constitution and need to understand what exactly the amendments are.
