  1. Not so easy-peasy. If you are not being recorded when you demand a lawyer for all questioning, then you did not request a lawyer for questioning. Police are trained to lie to suspects, and I have met many that are 100% willing to lie to earn their next raise. If you are not in custody, and the interrogation is not being recorded, it's up to the cop to decide if he wants to report that you demanded a lawyer. If the cop lies about your lawyer request, then at the very least they can use your refusal to answer questions as evidence of guilt in court (Salinas v. Texas). Bottom line is always record all police contact when you are not in custody, or they can and will say whatever they want about what was said, and the judge/jury will believe them over you nearly 100% of the time.

  2. I've seen all the rules from above being broken yet people are still getting put away. I seen this on the first 48 myself. They interrogated a guy for more than 8 hours then switched detectives. The detective played the simple minded nice guy and got the guy to confess.. They treated this detective like a super hero and bought him an expensive cake. I guess maybe the confession was valid but we are talking about an edited tv show so who knows. Also I do not think interrogations should turn into computations. What do they think could happen. Also the people themselves need to smarten up. If your on a jury it's your responsibility to make sure or rights were met. If not you are the bigger problem.

  3. When someone is questioned during traffic stop without miranda warnings, although they may be used for probable cause, can those fact finding questions still be admissible in court as evidence?

  4. Every government official violating the constitutions Bill of Rights should be charged and convicted of treason. It would get rid of the corrupt and stupid people making decisions for everyone.

  7. @7:38 You mention "…if the officer misrepresents the body of evidence collected against the suspect." Officers fabricate, lie and misrepresent all the time in cases, baiting suspects into incriminating themselves or confessing. Where is the line drawn? If the officer says, 'we've got your fingerprints, we've got witnesses, video' and they have none of that, is a confession rendered inadmissible?
