Think of it this way, if a person has the mental fortitude to say "I don't answer questions" while having a concise, calm and predetermined state of mind the likelihood that the person is intoxicated and is of not sound mind would be rare. At that moment the officer also has the chance to visually inspect the driver for dilated eyes, smelly breath and other 'in plain view' items that would otherwise constitute further investigation. Since the officer did not see or detect any one of those items that suggest further investigation is needed, the officer must release the driver and is free to go. (Disclaimer; IMHO)

This officer actually understood how the interaction works. Most people don't realize this but the officer is doing all of the checks as the interaction is taking place. The answer to the question is irrelevant its the interaction that matters. They can see your eyes and demeanor, more then likely smell if there is an odor of alcohol, and if you talk at all they can tell by your speech patterns. The only reason cops get butthurt at these checkpoints when someone refuses to answer a question is their Egos. This officer did his job without his ego being involved. Well done.

I actually do agree with DUI check stops, but only for when the statistic goes up. I live in SC and we have signs that count how many deaths we have had in our city from DUI. Every year trends between 1k and 1200 for DUI deaths. The worst thing is that usually the DD lives, and it is innocent people that are being killed. Parents and children. Btw it starts at zero on new years day, but it is always about 100 by noon. Maybe you dont want or need DUI check points but I do want them here and we dont have them.

While the infringement on the individual during a Dui checkpoint stop is minimal perhaps taking a minute or two, you have to consider the total amount of time or the total infringement on all people who were stopped. Not just for the interaction with the police but having to wait in line to be questioned. Those minutes add up.
When you compare the total time wasted of all those whose are stopped to the actual dui checkpoint conviction rate, it becomes very clear the total infringement is very large compared to the minimal number of people actually convicted. The unreasonableness is on the order of a conviction rate of less than 1/10 of 1% for every car stopped. So for 1000 cars stopped there is only one conviction for dui. It is therefore unreasonable to subject the innocent population to this wasteful and futile policing action.
One gets the feeling that dui checkpoints are
1. A PR stunt by police
2. A revenue policing operation akin to a highway man and
3. A way to reduce the number of police on duty during a holiday

The legislative branch is failing us. They and the executive branch are supposed to keep the judicial branch in check. When the court makes a bad call, laws are supposed to be passed to clarify the issue. DWI checks are clearly illegal under the Constitution and it seems we need a clear law, that the court can understand, saying these illegal checks are illegal.

My sister and her sister-in-law were murdered by a kid that was "tired" when he rear ended them at hiway speed and pushed them into oncoming traffic. Because he wasn't drunk they let him go! This wasn't a tragic accident but reckless driving that was excused. Any wonder my hate for cops is endless?

I WISH I could answer a police officer in my country like that, and it ends that quickly.
They'd get all in their feelings and become hostile, demand my ID and insurance and search my car, and I'd be at risk of getting arrested for "using insulting language" depending on what I say to them.
(Police have the power to demand ID, car insurance and search your car without reason in my country)
