Is There a Right to Loiter?



Quite a few people sent me this video of Travis Heinze being told to leave Turtle Lake, Wisconsin, for β€œloitering.” I’m pretty sure I watched this play out in Rambo First Blood. Is this constitutional? Loitering ordinances have been misused by law enforcement for many years. The problem is, they create a criminal offense based on one’s mere presence in a public place, with the lack of any criminal intent. Therefore the police get total power to define who is a criminal, and who is acting lawfully. Of course, this can, and is, misused by police. Which is why the federal courts have addressed the constitutionality of these statutes.

  1. Loitering laws sound all nice & good until they're used on the wrong guy. One day, the police chief tells a drifter to leave town. The drifter wants to eat first but the cops arrest him for loitering. Next thing you know, the guy escapes jail & is being chased through the woods where he gets the better of the cops & one cop accidentally dies falling from a helicopter after which the National Guard is called in. An Army officer shows up & explains the drifter is actually a highly trained special forces veteran who is highly decorated, even receiving Medal of Honor. The National Guard thinks they kill the drifter in an old mine but they were wrong. Before you know it, the drifter is attacking the town. He blows up a gas station, shoots up the police department, & damn near kills Brian Dennehy but stops himself.

    Later on, the government has to get the drifter out of prison to go on a mission to find POW's still in Vietnam. He ends up finding them, rescuing them against orders, watching a woman he connected with get shot by a Vietnamese officer, & eventually fight off Russians to save the POW's.

    After that, he does similar stuff in Afghanistan, Burma, & then in the US fighting drug cartels.

    In the end, it would have saved a lot of trouble to just let the guy get a meal & continue on his way.

  2. The only criminal in this video was the chief of police.
    Jerseyville, IL is like this.
    If you were not born and raised there, don't be there.
    If they do not know you, like your hairstyle, your color, your nationality, … you will be run out of town, arrested, and tuned up with tasers.
    They also kill children for carrying Bibles.

  3. You would think this cop realizes how evil he really is but I not so sure. I quite sure he thinks this encounter is simply between Travis and himself. What a surprise he must feel when he realizes how many ordinary people will see the video.

  4. I can't tell you how much I love when cops tell you how they are not going to DISCUSS or DEBATE your rights as they screw you out of them, all for the great and all consuming purpose of getting their way regardless of its legal or not.

The constitution is suspended in Turtle Lake, loitering stand or wait around without apparent purpose. just because you don't know the purpose are too far ranging, if someone is standing he has a purpose his purpose could be standing and count vehicles. This needs to be struck down immediately. Travis got the village to remove that policy, win for the people.

  6. Violation of 1st amendment right to engage in introspection, thinking in relative peace, to engage in meditation, religion, etc. It is frankly obvious mankind has a right to "loiter".

  7. Of course loitering is a right. You have a right to do nothing, to meditate, to think, to introspect, to rest, to sleep, etc. If you think there is no reason to loiter you are lacking an imagination. Also, a complete violation of the 13th amendment. So what I have to "act with a purpose"…FOR YOU and not for me? That's called involuntary servitude which is not legal.

  8. I am sad to still be alive and affraid to drive out of state or even out of town any longer. I was lucky my last trip from Fl. To Texas. Georgia officer followed me around then pulled me over, I was lost and looking for a place for my dogs to go potty. My dogs would have bitten him. I had to ask many times NOT to put hands on my car window. After showing ID and telling him what was going on, he did tell me where to let my dogs go and yes, he came along… I had to be certain he did not get out. Dogs trained to break on command. Load on command but hated men. After the dogs were back in the car, he gave me strict directions on how to leave town. Yes, he followed part way. I have not left Texas. However, Texas officers are sometimes not so nice either.

  9. He's also been forced to move for simply parking off to the side , well off the shoulder of what the officer said was city property and it was not posted privet, they made him leave. The road was not far from a park, was gravel nut I would think that the state and city receive federal money and he was well with in his right to park and rest. As we all have the right to travel , people also have a right to pull over and take breaks as needed on these roads and highways. The things they pull on him simply because how they judge him for his property and socal display and communications. It all boils down to most officers need that desire to be in all God authority. My last hurra here,
    Qualified Immunity Has to go. Now after this week month of such police crimes. All Americans have to keep demanding that congress passes this bill finely. Tell your congress person that if they do not do as we demand, that we will replace them with someone who will. Enough is enough. This law got stalled for the last year now, to many politicians on someone's payroll.

I fear one day some bad little city will bring harm to him and abouse him and lock him away. So I am very glad your coving him. Makes me feel better there are good people looking out for him. Thanks

  11. When we went to Turtle Lake to see this anti American Town and their Cop << He retired i guess << Damn it Man < just looking to get paid , they must have plenty of Money to throw around << / we will try again

  12. Quote from former chief Gabe "We don't have a problem with people coming to the community,” he said. β€œBut if you don't want to identify yourself, that’s an issue. We want to know who you are.” No 4th amendment applies here.

  13. My father as Chief of Police in Hackett AR arrested an interracial couple without cause. They were detained overnight before being told "Don't let the sun set on your heels in the Town of Hackett" that was early 1980s. Their crime was being an interracial couple in Hackett AR in the early 1980s.

  14. Very disturbing. All cops take an oath to protect the constitutional rights of citizens to serve and protect. I was shocked to hear about this ordinance. I thought Wisconsin people were overly nice and welcoming. They should encourage and welcome outsiders to their town. I have recently read that this town has suspended this ordinance and they need to permanently scrape it from their ordinance list altogether before someone sues.
