CABELL COUNTY, W.Va. (WCHS) β An off-duty deputy that was driving a cruiser that struck and killed a young girl in Cabell County in December has resigned.
Jeffrey Racer resigned as a Cabell County deputy effective Friday, according to a news release from sheriff Chuck Zerkle. Racer had been on administrative leave since the incident in late December 2022.
βAt the present time I am not at liberty to talk about personnel matters or respond due to pending litigation,β Zerkle said in the news release.
A cruiser driven by Racer struck and killed Laney Hudson, 13, on Friday, Dec. 30, near the intersection of Fifth Avenue and 31st Street.
The incident has drawn months of protests calling for justice as separate investigations by the West Virginia State Police and the Kanawha County Sheriffβs Office have taken place.
West Virginia State Police investigators said alcohol was not a factor as Racer passed breathalyzers and field sobriety tests. They also said the light was green at the time.
Prosecutors most recently said that no data was obtained from the black box in Racerβs cruiser due to the vehicle being too old.
The Kanawha County Sheriffβs Office told Eyewitness News it completed their internal investigation into any potential Cabell County Sheriffβs Office policy and procedure violation and sent it to the Cabell County Sheriffβs Office last week.
Putnam County Prosecutor Mark Sorsaia provided Eyewitness News with the following statement:
His [Racer's] resignation has nothing to do with our investigation . I hope to have a resolution soon.
Attorneys representing Hudsonβs family said they were surprised by Racerβs resignation.
βThe news that Jeff Racer resigned from the Cabell County Sheriffβs Office this afternoon came as a shock to Laneyβs family,β a statement from Haslam Law Firm said. βOur office was in contact with counsel for the Cabell County Commission this morning and there was no mention of even a possible resignation.β
The law firm said it has not currently filed a lawsuit in the case.
βAny statement from elected officials that they cannot comment on this matter due to pending litigation is interesting because the family has not yet filed a civil suit,β the statement continued.
Attorneys vowed not to stop getting answers for Hudsonβs family.
βRegardless, Racerβs resignation does nothing to stop our quest for truth. We are nearing four months since this happened and each day that passes creates more questions. We will not stop until those questions are answered,β the law firm said.
Racer has not been charged in the incident.

Hopefully the many witnesses will have an opportunity to give sworn statements, right now the investigators haven't even contacted them. 15 days and the investigators are still trying to hide the testimony of these many witnesses that actually seen the speeding car and the killing of Laney. Hopefully, the video from the traffic cameras, that record the intersection, will not be destroyed, The cops have already, preemptively claimed, the video cameras didn't work for this incident. Hopefully, the "black box" data will reveal the vehicle speed, but this normally VERY reliable source of vehicle data, has already been preemptively removed from consideration for recoverable data…..Right now, according to the police, NO WITNESSES, NO VIDEO, and NO BLACK BOX DATA….Hmmmm,…
