Refusing to provide identification is not "interference" when no crime has been committed, is being committed, or imminently about to be committed. The pipes and marijuana residue are all "fruit of the poisonous tree" and cannot be used as evidence of a separate crime.
The officer proves that he lacks knowledge not only of Iowa statute 719.1 but also of Terry v. Ohio, which he cites as his authority to demand identification, to detain the man, and to search him. The city attorney also demonstrates his lack of knowledge by supporting the officer by proceeding with a prosecution that was summarily dismissed by a court of competent jurisdiction.
The key to charging "interference" is that a "person knowingly resists or obstructs anyone known to be a peace officer…in the performance of any act WHICH IS WITHIN THE SCOPE OF THE LAWFUL DUTY OR AUTHORITY OF THAT OFFICER." Well, the officer in question had neither a lawful duty nor lawful authority to demand identification from the victim in this case.
Both the officer and the city attorney should be personally fined and also spend several years in prison for violating this man's rights.
OBSTRUCTING JUSTICE, §719.1
719.1 Interference with official acts.
1. a. A person commits interference with official acts when the person knowingly resists or obstructs anyone known by the person to be a peace officer, jailer, emergency medical care provider under chapter 147A, medical examiner, or fire fighter, whether paid or volunteer, or a person performing bailiff duties pursuant to section 602.1303, subsection 3, in the performance of any act which is within the scope of the lawful duty or authority of that officer, jailer, emergency medical care provider under chapter 147A, medical examiner, or fire fighter, whether paid or volunteer, or a person performing bailiff duties pursuant to section 602.1303, subsection 3, or who knowingly resists or obstructs the service or execution by any authorized person of any civil or criminal process or order of any court.
