  1. Few comments. Heller should have over turned nfa rules all together. Pre nfa regulations, many people commonly owned machine guns. Weapons like the Tommy gun and bar where extremely popular. In addition US v Miller should have over thrown the nfa regulation on machine guns.as stared that case clearly states protection of people's 2nd on weapons used by Militia for protection of the nation. However seeing we can't get a case to the supreme court to prove these case law points we can't undo the infringement

Using the logic of enacting gun control laws that the lawless will ignore, but which will restrict the law abiding, I've discovered the legal utopia that will solve America's crime problem forever and always. Enact a law mandating criminals obey the law. Problem solved….. Genius says you. Leftist logic say I.

  3. The idea of citizens being able to arm themselves is not limited to only being able to defend themselves against cavemen. The fact that we are able to defend the country from invasion is important. I don’t think cavemen are the only ones that would be a threat. But the ability for the citizens to be able to defend themselves from the state. Tyranny has a leg up on the population when the tyrants can outgun the population. The powers that be today are not interested in protecting the public welfare from gun violence, it’s goal seems to be one of disarming citizens in an attempt to prevent the citizens from being able to defend themselves from a tyrannical take over.

  4. The most recent year I could find correlating data for is 2017. According to Small Arms Survey, there were ~393,347,000 civilian owned guns in the USA in 2017. According to the CDC, the total number of deaths from firearms in 2017 was 39,773. Homocide accounted for 36.6% of those 39,773 (=14,557). That means there were 27,021 firearms owned per every ONE homocide. If you include suicide, accidents, justified use, etc. It's 1 death per 9,889 firearms. They would literally have to confiscate 9,889 guns to prevent 1 death (on average), and that's assuming that all the would-be murderers turn in their guns at the same rate as law abiding citizens – good luck with that. To prevent 100 gun deaths, they would essentially have to take over one million firearms (100 deaths x 10k guns) – again, assuming all armed criminals turned in their guns at the same rate as law abiding citizens. 1 million firearms would only be ~.0025% of the total civilian owned.

    To put these numbers into context a little bit there were 272,480,899 motor vehicles registered in the USA in 2017. 37,133 people lost their lives in motor vehicle crashes in 2017. That means for every 7,337 cars registered there was 1 death. Even though guns are "designed to kill" and cars are literally jam packed full of safety features designed to save your life, the object to death ratio is higher for cars. (Granted, there's probably more people driving cars vs shooting firearms every day.)

    From cdc.gov: Although definitions of defensive gun use vary, it is generally defined as the use of a firearm to protect and defend one’s self, family, others, and/or property against crime or victimization. Estimates of defensive gun use vary depending on the questions asked, populations studied, timeframe, and other factors related to the design of studies. The report Priorities for Research to Reduce the Threat of Firearm-Related Violence indicates a range of 60,000 to 2.5 million defensive gun uses each year.

    60,000 defensive uses per year (on the low estimate) VS 39,773 firearm deaths (on the high estimate). Just for fun, let's selectively use statistics to make my argument look better like the media does – 2.5 million defensive uses vs 14k homocides. That implies that you're 178 times more likely to use a firearm defensively than you are to get killed by somebody with one. Personally, I'd rather take my chances and have the right to defend myself, and also not leave all the stay at home moms, elderly, etc. even more vulnerable than they already are.

    None of these statistics should even matter when it comes down to it anyway, because it's supposed to be a right, not a privilege. They knew about the puckle gun, blunderbuss, canons, etc. when they wrote up 2A. Muskets WERE "weapons of war", but they didn't limit people to knives, swords, bows and arrows etc. It's bad enough that we have people arguing against the second amendment, but it's even worse when they claim to support it while simultaneously attempting to undermine it.

  5. Executive action is legal, the executive has discretion to enforce the laws created by congress.

    Legislative delegations to the executive branch are wholly unconstitutional

  6. Say what you want, but the constitution has been a living document, because the American people are threatened with violence to comply……. Just look at the 2nd Amendment today: Militia is forbidden as the police state has suppressed the free state, the privilege of citizens 21 years of age who are non-felons & mentally sane may keep but never bear the small arms government allows, this may be altered when government feels threatened by the people.
    If it does not say that today, you are lying to yourself.

  7. The problem with our court system is it takes 2 years for scotus to overturn executive orders, and 20 years for 50% of the public to understand that order wasn’t and isn’t law.

  8. If I can't own anything and everything the U.S. military owns, how am I going to be able to protect myself against an out of control government? The whole purpose of the 2nd, was and is to protect ourselves from a tyrannical government!! PERIOD!!
