In a "free" country, outside of a gated community and other "secure" areas, there's no such thing as even being in the wrong neighborhood. For a cop to say that they have to check whether people belong there because it is 1:am and the area had issues in the past, they could argue that everywhere. It's a disgusting abuse of perceived power. I hope he gets "corrected".
Simply asserting a Constitutional right IS NOT grounds for raised suspicions of criminal activity sufficient to justify a search or lengthy stop and detainment. Imagine if this position was the state of the law, granting police extra authority if a person merely asserts his right to free speech, or the right to ask for an attorney, or the right to have your own religious view, etc… It is time for many of the police to go back and learn the law BEFORE they go out to enforce it.
First of all, don’t “go to the Chief for a talk” when civil rights were violated. You interview attorneys until you find one you want to retain. Then, you sick the attorney on them! Get a Pre-paid Legal membership and get access to Justice.
