John Sears has traveled the state of California with his mules for the past eight years. On January 21st, he filed a lawsuit alleging that the California Highway Patrol unlawfully arrested him in violation of his natural, Constitutional and statutory rights.

On January 23, 2020, the Mules were walking along Lake Nacimiento Drive, a rural two-lane country road in San Luis Obispo County and the only route between Bradley, California and Paso Robles other than Highway 101.

The road is hemmed with steep banks on both sides of the road. It has narrow to non-existent shoulders in many areas. The non-paved area directly adjacent to the road was a steep upward bank, which would be difficult to impossible for a pack mule to navigate.

Fortunately for the mules, The California Vehicle Codes provide all non-motorized travel equal access to the public thoroughfare. Veh. Code § 21050

California Vehicle Codes 21759 states: “The driver of any vehicle approaching any horse drawn vehicle, any ridden animal, or any livestock shall exercise proper control of his vehicle and shall reduce speed or stop as may appear necessary or as may be signaled or otherwise requested by any person driving, riding or in charge of the animal or livestock in order to avoid frightening and to safeguard the animal or livestock and to insure the safety of any person driving or riding the animal or in charge of the livestock.”

On January 21st, he filed a lawsuit alleging that the California Highway Patrol unlawfully arrested and imprisoned him in violation of his natural, Constitutional and statutory rights. The complaint also includes a violation of the Bane Act.

In addition to his damages, he seeks a declaration of his rights that he can present to law enforcement in the future, and for the CHP to issue a training bulletin informing officers of the right for equines and other animals to use the public thoroughfare.

The right to travel is not only enshrined in the United States and California Constitution, but dates back to at least the Magna Carte in 1215.

Equating travel with the notion of “liberty”, the U.S. Supreme Court stated:

Freedom of movement across frontiers in either direction, and inside frontiers as well, was a part of our heritage…It may be as close to the heart of the individual as the choice of what he eats, or wears, or reads. Freedom of movement is basic in our scheme of values. (Kent v. Dulles (1958) 357 U.S. 116, 126.)

  3. here is an idea, maybe traffic cops should be able to quote the law that was broken before arresting people?
    "I don't like the way your donkeys were looking at me" is not a valid reason.

  4. Based on the update it seems like the officers didn't lose qualified immunity because the standards weren't met. If officers have access to a system for verifying laws before they accost people with threats and violative acts such as arrest they should be held accountable for those choices – period.

Habeas corpus dates back to the Magna Carta too but Following the December 1, 2011, vote by the United States Senate to reject an NDAA amendment proscribing the indefinite detention of U.S. citizens, the ACLU has argued that the legitimacy of Habeas Corpus was threatened: Nevertheless, the Senate voted 38-60 to reject an important amendment [that] would have removed harmful provisions authorizing the U.S. military to pick up and imprison without charge or trial civilians, including American citizens, anywhere in the world. So… because of Obama and the Congress at the time, we can now be thrown in prison without charge and indefinitely.

  6. The road pirate did exactly what he was hired to do; make arrests (whether good or bad is irrelevant at the time of the arrest) putting people into the Just-Us Criminals' System, generating revenue for the State, and making his jacket look good.

    Rule # 1 Cops make shit up ALL THE TIME.
    Cops should not be allowed to tell you something is illlegal when it's not. The MUST be consequences to them doing it. If they don't know the law, they shouldn't be trying to enforce it. And worst of all they should not be trying to enforce a law that they just made up out of thin air.

  9. It's almost like a lot of these so called police are sociopaths. Kinda crazy how police exams can have IQ caps where if as person is to intelligent they are legally allowed to disqualify the person from working for police but very little psychological tests to disqualify sociopaths like this guy here..

  12. OMG! This officer needs to get a life!! Kids walk down the street, kids ride bicycles on the street, people walk dogs down the road. Sooooo, a mule can’t walk down the road?!?! I’m glad he sued them. It looks like a long country road. All cars go by everything I mentioned above. Good grief…..

    Animals do not have a "right to use the public thoroughfare." Animals do not have the human intelligence and conscience necessary to exercise "rights," including the "right" to "use" the public thoroughfare. This is self-evident as demonstrated many times whereby law enforcement, animal control officers, and people have necessarily forced wild uncontrolled animals off of the roads for the safety of human travelers. People have a "right to use an animal" for their purpose on the public thoroughfare. This may seem to some a minute distinction, however the arguments of people that animals have rights 1) would place animals on equal Sovereign creation with mankind and would afford animals a "right" to compensation for violations,.. an impossibility, 2) has led to an increase in the breakdown of society including frivolous suits by people for personal gain, and 3) has caused violations of the rights of people. Furthermore, as demonstrated in this mule/cop interaction, cops have little more (if any) human intelligence and conscience than a mule to comprehend and apply their own "laws." This is why they've earned the appropriate euphemistic barnyard animal title "pig." It is critical that this distinction be painfully explained to pigs lest the pigs become even more confused and arrest each other, which would be just, and quite entertaining!

  14. The cops could have checked in 5 mins flat and found out they were completely wrong … The judge was very soft on the officers IMO… I hope the litigant took a tidy sum off those clowns.

  15. This case should not take years it is cut and dried. They are just waiting for the old fella to pass away so that the lawsuit passes away with him. I hope he has heirs to take up the baton and run this case forward to each end, and I hope he doesn’t die before it ends

  16. If the arrest was not legal why should Mr Sears have to pay to get his property back ? It makes no sense. Mr Sears is just doing what millions of Americans did for many many years. Officers really need to know what is legal.

  17. It absolutely blows my mind that he's requesting something to show police stating his actions are lawful 🤯 Is this what we've come to?? That each of us need something to present to cops showing what's lawful?? To show them WHEN they are allowed to ask for our driver's license? To show them THAT it's lawful to give a cop the 1 finger salute? To point out it's lawful to stand on a sidewalk and record whatever you want to without impeding on an investigation? If WE have to teach police WHAT to do, where's our paycheck? What good is a police officer if they have this hive-mind that they don't need to learn the law AND we must unquestionably follow orders while THEY get qualified immunity?? Absolutely disgusting AND disgraceful! 😒

  18. We need 1 new law that says if you wrongly enforce a law you get canned. I'd rather cops take a cautious approach and let someone walk if they don't know the damn laws they chose to enforce.

  19. If they were actually concerned about safety they would have given him an escort instead of making the convenient, tyrannical and 'permissible' decision to violate the man's rights with made up laws and charges
