Just a few short minutes into the incident, the temporary license plate can be seen in the window. Later in this video, Officer Crocker can be heard acknowledging that he saw the plate.

However, there is a double standard between citizens and law enforcement. Code of Virginia 46.2-1052 requires rear window tint to allow 35% of light through. It is unclear whether this window tint is lawful or not, but it does seem to occlude the temporary plates. Nazario drove for almost a mile before pulling into the gas station, which took one minute and 40 seconds to travel.

These three factors technically make this a lawful traffic stop. And in the 1977 supreme court case of Pennsylvania v Mimms held that The order to get out of the car, issued after the respondent was lawfully detained, was reasonable, and thus permissible under the Fourth Amendment.

The officers could have communicated better at this point, but the order to get out was lawful. But in a moment, it becomes more understandable why Lieutenant Nazario was afraid to extract himself.

Paramedics arrived soon after to treat him and eventually, he was released without charges.

Lieutenant Nazzario left the scene and since the incident has gone viral he has filed a lawsuit that claims unlawful seizure, excessive force, illegal search, violating his First Amendment right to free speech, and common law assault, battery and false imprisonment.

The governor ordered an independent investigation to determine the appropriateness of officer Gutierrez’s action which found that Department policy was not followed, and the most recent news is that he has been fired.

  1. Imagine a police officer recognizing the hard work that it takes to earn the rank of Lieutenant in the military while simultaneously using that hard work to threaten that very military officer. Oh wait! We dont have to imagine it. We just saw it.

  2. The police made my point about treating every stop like martial in a foreign countries war zone . Time to roll back their authority and latitude so they are compliant with the law

  3. “What would you have done?” …. Umm, personally I would have informed the occupant of the vehicle WHY I stopped them and WHY I have my weapon drawn. Instead of just barking orders.
    Why does this basic stuff seem to be so very hard for the police to convey?

  4. Sad how people escalate things. Both sides are wrong. Especially the police. Its sad how groups like blm, nation of Islam, the prolific crime of a group causes actions like this.

  5. You know what causes this problem I'll tell you what causes this problem. The breakdown in the chain of command in our police departments. In the armed services when a private screws up his Sergeant is in trouble. When was Sergeant screws up his Lieutenant is in trouble. In our Police Department's when an officer screws up no one is responsible except that particular officer. Fix the chain of command and this problem will disappear

This soldier DID EXACTLY THE RIGHT thing and these joker officers came in with guns drawn before even assessing the situation.. the soldier drove slowly and deliberate to a well lit area..he had a paper tag as it was a new vehicle and these two gun toting freaks couldn't see that. They wanted to "tune him up" and luckily the Hispanic prick officer was fired. The other officer I believe was not disciplined. Their Chief initially defended their actions as usual playing the victim card. There was no reason to pull their guns, intimidate and assault this soldier.

  8. ALL OF THIS INCIDENT has to do with one thing and one thing ONLY!!…. Power tripping EGO!! If I was that guy, I would be afraid for life to exit the vehicle as well. Those tyrants were not displaying normal controlled behavior. They were acting like they were in some kind of drug fueled rage while pointing a loaded firearm at an INNOCENT MAN, not to mention he was Active Duty military IN Uniform and this was supposedly just a minor traffic stop for a paper license plate. I mean, what the hell!!?? Cops in our country are SO OUT OF CONTROL and people are SCARED OF THEM!!! They always say they do things for officer safety because lots of cops have been killed, but lots of INNOCENT PEOPLE have been killed for no reason at all by police so we do things for citizen safety!! It's too bad only one tyrant was fired and NONE OF THEM were charged with the extremely serious dangerous felonies they committed on camera! Typical corrupt Prosecutors, the entire system is corrupt and almost never protects the rights of citizens or holds government agents accountable for anything, which is why we don't trust them and are scared of them. All of those cops on the initial stop should be fired and charged and arrested!!

  9. I'm confused…what happened to cause them to pull out their guns and then pepper spray this soldier? I mean they did it because his license was not in the correct place? These cops appeared absolutely hostile, screaming at him, ride the lightening, guns drawn with him as the target. I would have been terrified to get out of the car. And at the end, they had the audacity to look like how they were doing him a favor by not writing a ticket? Who do you call when cops point their guns at you and act like a bunch of Thugs????
