Vince is a nurse and was on his way to the nursing home where he works. His longtime girlfriend was driving him. They were pulled over on an allegation of the car going “left of center.” The traffic stop actually ended and a warning citation was issued to the girlfriend/driver. But then, suddenly Barbour County (WV) then-Deputy Christian Mayle ordered both occupants out of the vehicle. When Vince questioned his authority to do so, the officer cited Pennsylvania v. Mimms and quickly lost his temper, macing Vince and pulling him violently from the car. There’s a huge update.

  2. The case is for officer safety only. It also requires Terry v Ohio to be done if officer is claiming officer safety. Which means do a pat down for weapons and have the person to remain outside the vehicle for the duration of the stop. If an officer removes you from the car and doesn't check for weapons, it's a violation of the reason Pennsylvania V Mimms allows officers to remove from the car. Officer safety is the only reason that Pennsylvania V Mimms allows a person to be removed from the car. But police abuse this by making everyone exit car even when officer safety is not an issue.
