  1. Your explanation about police not having to give the reason for the stop before demanding ID is not accurate. True that police may detain without disclosing, but, even in states with a statute which criminalizes refusal to ID, they may not arrest you for their statutory crime of refusal to ID when you have not been given the basis for the stop, simply because it is impossible for a citizen to have mens rea (guility mind) if they have no knowledge of the legality of the stop. In order to arrest you, they must put you on notice and put the onus on you. So, yes, they may detain you and not disclose the reason, but they may not charge you with a crime for failing to ID. They may hold you as long as it is reasonably necessary to ID by some other means, such as fingerprinting, but it must be necessary under the circumstances.

  2. The deputy committed deprivation of rights under color of law by coercion. He should be facing a 2 year prison sentence, and the loss of his ability to work as a public servant for life. Why are we allowing our public servants to commit crimes like this on a regular basis?

  4. Generally speaking, no. Police do not have to tell you why they are stopping you before asking for ID in a traffic stop, though it may be a standard practice in many areas. The officer must have a reason—i.e., probable cause—for the stop, but they are not legally required to tell you.

    so if the cop feel they have a reason to pull you over, then YOU have to give ID, cop legly in the right. and could arrest him for not giveing ID.

  5. It takes a bigger man to admit he was wrong, and change direction, then the small minded that get feelings and have to casue pain to others, just because they can. My hat is off to this police officer.

  6. You've here of SOP standard operating procedure, theres also something called AWP accepted working practice. It's where the SOP states one thing but the department allows, overlooks, trains or encourages/expects something else. It happens all the time.

  7. I can tell you exactly why that happened! Because that department trains and unofficially requires them to do this! The officer seems like he doesn't want to do this but is being forced/ intimidated to do this to keep his job. Yes he should tell the powers that be to fuck themselves and go to the media but we all know what happens to whistle blowers! The whole political system in this little town is most likely criminal from the police chief to the mayor to the judges.

  8. Government officials should be required to inform citizens why they are being detained. Often they lie and make up a reason afterwards. Falsifying documents and perjury are not taken as seriously as they should be

I feel like he had potential to be a good cop , the unlike most officers, he didn’t technically even try to do anything wrong , didn’t force a search, didn’t try to plant something, didn’t waste to to much time , I got pulled over for a hour the other day just for a 7mph over ticket, feel like it could have been 7 mins but they we’re probably trying to find something to hit me with but I gotta a clean record unfortunately for them

  10. I think the guy escalated the situation by yelling and cursing at the cop. The cop was definitely wrong to pull this guy over, but the guy is really lucky the cop was a good guy and didn't escalate in return, most cops have a huge ego and this can be a quick way to get arrested.

  12. No bumper just another false reason to try to give you a ticket for something else. Sadly in court they have to give you a reason but not at the stop because if they gave it to you at the stop then you could avoid going to court but they just want to waste your time and money when you fight it
