I dont know what Colorados law or case law about smoking weed is though. So take my opinion for the case that its totally illegal, clear cut, no questions. A more nuanced legal situation would have required a more nuanced approach and maybe the suspicion of DUI wouldnt even have been valid making all the resisting potentially lawful and subsequently the cops actions criminal.
