  2. One question allways show up in my mind when watching videos of this kind. Do popos in the US have to go to some kind of school to be elegible for the job? Or just do some hours on the shooting-range and have a drivers license? They seem sooo undereducated. In my country they have to have at least common sense.

  3. As long as you remember that criminals don’t follow any laws and they do whatever they want, you’ll not just know why, but you’ll expect your rights to be violated, your car door opened unlawfully, and other misconduct to occur.

  4. Okay… First let me say that I'm black but… I'm starting to wonder if women, black people, especially black women, or any people of color should be cops. I'm sorry but so many of these videos of cops stealing, violating rights, having an attitude, being violent disproportionately feature female or minority officers. Don't get me wrong, there's plenty of white boys messing up but they are over 60% of the national police force. Women are only 13%… of any race. 12% are black men… Yet here we are, day after day, seeing videos of them clearly misusing their authority.

  5. The cop seizing the firearm was outside the car when he saw it, so it was plain view from a place he was legally allowed to be. The vehicle exception to the 4th would most likely allow him to enter the car and sieze it, IF their state and local laws make carrying a handgun in a car illegal without a permit. That's not the case where I live, so this would be a bad seizure here, but it's possible that he was legally allowed to open the door and sieze it. Yes its outside the scope of he original car stop, but if it's illegal to carry this way then seeing the gun in plain view does allow the cop to expand the scope because he's discovered a new crime (again i don't know the state or local laws so I don't know if this could be a crime).

    My point is, opening the door and entering the car is legal IF he's seizing contraband he saw from plain view. I don't know if the gun counts tho.

    However it's a bad tactic regardless. The cop was leaning into the car with his own right hand extended away from his own gun. If the driver had snatched the gun and turned it on the cop, the cop can't jump back or draw his own gun. The cop definitely has the power to order the driver to exit the vehicle and that would be safer, because it would get the guy away from the gun and if the driver did attack, the cop would have access to his own gun and mobility and cover with the car between them. Legal maybe smart no.
