The Congressional debate on the Civil Rights Act of 1866, as recorded in the Congressional Globe, 39th Congress, 1st Session, provides explicit statements by Senator Lyman Trumbull, Chairman of the Judiciary Committee and principal author of the Act.
Senator Trumbull on Liability of Officers:
Senator Trumbull stated:
"If any person, under color of any law, statute, ordinance, regulation, or custom, subjects, or causes to be subjected, any inhabitant of any State or Territory to the deprivation of any right secured or protected by this act, he shall be liable to the party injured in any action at law, suit in equity, or other proper proceeding for redress."

Trumbull further clarified the absence of sovereign immunity for such violations, declaring:
"There is no protection for any person, high or low, who, under color of law, deprives a citizen of the rights secured by this act. The officer who executes, as well as the officer who commands, is made liable to civil suit by the party injured."

He emphasized:
