So let me get this straight, this cop wants to check the registration of the firearm which would require access to a database like the atf i mean, it's all fine.Well and good, if you want to check to see if the guy has a permit.But I think it's a little more complicated.If you want to check the registration of the firearm, it seems more likely that the cop is trying to make sure that the gun has a serial number.Which unless he has reasonable articulable suspicion i don't think he can do
They are allowed to run the serial number on your gun because it’s considered to be in Plain view but if they have to alter something to see the serial number it is not in Plainview. removing it from a holster would be a illegal search as I understand the law. You could also put a small piece of tape over the serial number and it would be illegal to remove it. (I do realize that altering the serial number is completely illegal and that’s not what I’m suggesting.)
