I don’t know if this is ever been thought of or proposed… I think there needs to be ramifications for the lower court getting it wrong.
I think this is by design and intentional for a multitude of reasons, including but not necessarily limited to knowing that people will give up because of the time money and effort involved. Lawyers will give up and secondly to generate more revenue to file the appeal that have more court costs, more attorneys fees, more filing fees, more court, reporter fees …. it’s a revenue generating system.
